9. Orders
All orders are placed subject to acceptance and availability. If the ordered goods are not available, you will be informed by email (or by any other means if no email address has been provided) and you will have the choice to either wait until the item is back in stock or cancel your order.
All orders you place will be treated as an offer to purchase our goods or services, and we reserve the right to reject such offers at any time. You acknowledge that any automatic acknowledgment of receipt for your order that you may receive from us does not signify our acceptance of your offer to purchase goods or services advertised on the website. A contract between you and us will be concluded when we (i) charge your credit card, debit card, or PayPal account or (ii) ship the goods to you or commence the services, whichever is later, in which case we will send you an email confirming that a contract has been concluded ('Shipping Confirmation'). The contract will relate only to the goods and services for which we have confirmed shipment in the Shipping Confirmation. We will not be obliged to deliver any other goods or services that may have been part of your order until the shipment of such goods or services has been confirmed in a separate Shipping Confirmation.
We will take all reasonable measures, insofar as it is within our power to do so, to securely store the details of your order and payment, but in the absence of any negligence on our part, we cannot be held responsible for any losses you may suffer if a third party gains unauthorized access to data you have provided by accessing the website or placing an order on it.
The products sold on the website are not intended for resale or distribution. You are limited to purchasing 5 items of a single product. We reserve the right to cancel orders and/or suspend accounts for/on which we believe products are ordered in violation of this provision. Please note that the risk of loss or damage to the products is only transferred to you once they have been delivered to the delivery address, and ownership of the products is transferred to you at the later of the following dates: (a) the products are shipped by us; and (b) we receive payment in this regard.
10. Cancellation Rights
When you have purchased goods or services as a consumer (that is, for personal use, as opposed to commercial use), please note that you have the right to cancel any contract completed with us within 7 days following the date of receipt of said goods or services ('Cooling-off Period').
If you actually cancel a contract within the Cooling-Off Period, then:
you must inform us by contacting us or by writing to info@theorientalherborist.com; you must keep possession of the goods or services and ensure that they are kept in the same condition as at the time of delivery until they are collected by us or returned by you;
We will inform you when we wish to take back the goods or services. We will take back the goods and services within 28 days following our receipt of your cancellation notice and we will charge you the costs of taking back the goods or services. These return costs are your responsibility. You must contact us before any return, so that we can validate this cancellation and provide you with the return details; a tracking number must be provided to us; we will refund any amount you have paid us within 30 days following the receipt of your cancellation notice.
If you return goods to us for any reason (for example, if you believe the goods are defective), we will examine the returned goods and, to the extent that we find them defective, we will repair or replace any defective goods or fully refund you the price of the defective goods (including any applicable delivery charges and any reasonable costs you incur in returning the item to us). Please follow our returns authorization procedure by contacting us via email. Please contact us as soon as possible and preferably within 3 days of receiving your goods. If we find that a returned item is not defective, you will be responsible for the shipping costs incurred. Details of your legal right to cancel and an explanation of how to exercise it are provided in the Shipping Confirmation. This provision does not affect your other legal rights as a consumer.
11. Price and Payment
All prices displayed on the site include VAT (where applicable) at the current rates and are accurate at the time the information is entered into the system. However, we reserve the right to change prices at any time without notice (except that any changes will have no effect on orders for which we have sent you a Shipping Confirmation).
You may be subject to import duties, taxes, and tariffs (including VAT), which are imposed once the delivery reaches your destination country. Such additional charges must be borne by you. (If your delivery address is within the European Union ("EU")) You should note that customs policies and practices vary significantly from one country to another. We recommend contacting your local customs office for further information. Payment can be made by one of the major credit or debit cards or via our PayPal account. Payment will be debited from your account before the shipment of your goods or the provision of the service intended for you.
In the unlikely event that the price displayed on the checkout page is incorrect and we discover this before accepting your order in accordance with clause 9, we are not obliged to sell you the goods at the displayed price. We always try to ensure that the prices of goods shown on our website are accurate, but genuine errors can sometimes occur. If we discover an error in the price of the goods you ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If you cancel your order after paying for the goods (but they have not yet been shipped), you will receive a full refund.
You confirm that the credit card, debit card, or PayPal account used belongs to you. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If your payment card issuer refuses or does not authorize, for any reason, the payment to us, we will not be responsible to you for any late delivery or non-delivery.
If your payment card cannot be debited for any reason, we reserve the right to retry the charge within 48 hours. In the event that the payment could not be processed, we will send you a 48-hour notice to the email address listed on your account to allow you to resolve the issue. If this poses a problem for you, you must cancel your order in advance.
You can only use one promotional code per order. We reserve the right to reject or cancel any orders for which more than one promotional code has been added to the cart.
We allow you to use discount codes strictly according to the general terms and conditions under which they were issued and which, among other things, may include conditions regarding your eligibility for their use and a maximum order value. Please familiarize yourself with these general terms and conditions before placing an order, as we reserve the right to reject or cancel any orders that do not comply with these conditions, even if your credit or debit card has been charged. In the event of any conflict between the general terms and conditions under which the discount codes were issued and these general terms and conditions, the discount code terms and conditions shall prevail. Customs Clearance Responsibilities
You are the importer of the goods and are responsible for all import formalities as well as all duties, tariffs, or taxes that may be charged by any customs authority.

These Terms are governed by and construed in accordance with the laws of England and Wales, and all disputes shall be exclusively resolved by the English courts.
17. Returns
Returns are entirely the responsibility of the customer.
In case you wish to return a product, for any reason, you have a period of 48 hours from the date of receipt of the order to inform us that you are not completely satisfied with the item. If you decide to return it, please contact our Customer Service and provide them with your order number, the item number you wish to return, and the reason for the return.
We will provide you with a return authorization number and the address to which you will need to send the product.
The item must be well packaged and include in the parcel:
Your order number
The reason why you want to return the product.
The returned item(s) must be new, unused, and in their original box perfectly intact with a copy of the invoice or shipping notice.
Once we have received the items, we check them and, if we deem it necessary, we will refund the amount paid for the items minus the shipping fees. We cannot offer shipping costs for unwanted items due to the perishable nature of the items we sell. We will only offer refunds/exchanges for items that are defective upon shipment.
