We will not tolerate fraudulent transactions and they will be reported to the appropriate authorities.

In carrying out these checks, personal information you have provided may be disclosed to a registered credit reference agency that may keep a record of this information. Rest assured that this is only to confirm your identity, that no credit card check is performed, and that your credit rating will not be affected in any way. All information you have provided will be processed securely and strictly in accordance with the Data Protection Act 1998.

You agree to fully indemnify us, defend us, and immediately declare upon request that we, as well as our employees and suppliers, are harmless from and against all claims, losses, fees, and expenses including reasonable legal fees arising from your failure to comply with these Terms, or any other liability arising from your use of this Site or anyone accessing the Site using your personal data.

For your information, we are not responsible for said websites or material, nor do we review or endorse them. We will not be held liable for the privacy practices or content of these websites, let alone for any damages, losses, or offenses caused or alleged to be caused by the use of or reliance on such advertising, content, products, materials, or services available on these websites or external resources.

9. Orders

All orders are placed subject to acceptance and availability. If the ordered goods are not available, you will be informed by email (or by any other means if no email address has been provided) and you will have the choice between waiting until the item is back in stock and canceling your order.

All orders you place will be treated as an offer to purchase our goods or services, and we have the right to reject such offers at any time. You acknowledge that any automatic acknowledgment of receipt for your order that you may receive from us does not signify our acceptance of your offer to purchase goods or services advertised on the website. A contract between you and us will be concluded when we (i) charge your credit card, debit card, or PayPal account or (ii) ship the goods to you or begin the services, whichever is later, in which case we will send you an email confirming that a contract has been concluded ("Shipping Confirmation"). The contract will relate only to the goods and services we have confirmed as shipped in the Shipping Confirmation. We will not be obligated to deliver other goods or services that may have been part of your order until the shipment of such goods or services is confirmed in a separate Shipping Confirmation.

We will take all reasonable measures, insofar as it is within our power to do so, to securely retain the details of your order and payment, but in the absence of any negligence on our part, we cannot be held responsible for losses you may suffer if a third party gains unauthorized access to data you have provided by accessing the website or placing an order.

The products sold on the website are not intended for resale or distribution. You are limited to purchasing 5 items of a single product. We reserve the right to cancel orders and/or suspend accounts for/on which we believe products are ordered in violation of this provision. Please note that the risk of loss or damage to the products is only transferred to you once they have been delivered to the delivery address, ownership of the products is transferred to you at the later of the following dates: (a) the products we ship; and (b) we receive payment in this regard.

 

9.1 Preparation, shipping, and delivery

All orders are prepared with the utmost care. Since most of our products are prepared, packaged, or assembled on demand, a preparation time of aboutthree (3) business daysis generally required before shipping. This time frame is given as an indication and may exceptionally be extended during periods of high activity or due to circumstances beyond our control.

Shipments are insured, depending on the case, byDHL Express, UPS or ASYAD ExpressThe carrier is selected at our sole discretion based on several criteria, including the nature of the package, the destination country, the customer's location, logistical conditions, operational constraints, as well as economic, social, or geopolitical situations that may affect transportation networks. For these reasons, the initially planned carrier may be replaced by another, including at the last moment, without this constituting a modification of the order or a reason for cancellation.

The average delivery time is generally betweentwo (2) and five (5) business daysafter shipment, depending on the destination and the chosen carrier. These times are given for information purposes only and do not constitute a contractual commitment.

Delivery delays may exceptionally occur due to circumstances beyond our control, including customs inspections, disruptions in transportation networks, natural disasters, social movements, conflicts, geopolitical tensions, government restrictions, or any other situation likely to affect international supply chains. In such circumstances, we cannot be held responsible for the additional delays caused.

10. Cancellation rights

When you have purchased goods or services as a consumer (that is, for personal use, as opposed to commercial use), please note that you have the right to cancel any contract completed with us within 7 days following the date of receipt of said goods or services ('Cooling-off period').

If you actually cancel a contract within the Cooling-off Period, then:

you must inform us by contacting us or writing to info@theorientalherborist.com; you must keep possession of the goods or services and ensure that they are kept in the same condition as at the time of delivery until they are collected by us or reshipped by you;

We will inform you when we wish to take back the goods or services. We will take back the goods and services within 28 days following our receipt of your cancellation notice and we will charge you the costs of taking back the goods or services. These return costs are your responsibility. You must contact us before any return, so that we can validate this cancellation and provide you with the return details; a tracking number must be provided to us; we will refund any amount you have paid us within 30 days following the receipt of your cancellation notice.

If you return goods to us for any reason (for example, if you believe the goods are defective), we will examine the returned goods and, to the extent we find them defective, we will repair or replace any defective goods or refund you in full the price of the defective goods (including any applicable delivery charges and any reasonable costs you incur in returning the item to us). Please follow our return authorization procedure by contacting us by email. Please contact us as soon as possible and preferably within 3 days of receiving your goods. If we find that a returned item is not defective, you will be responsible for the shipping costs incurred. Details of your legal right of cancellation and an explanation of how to exercise it are provided in the Shipping Confirmation. This provision does not affect your other legal rights as a consumer.

11. Price and payment

All prices displayed on the site include VAT (if applicable) at the current rates and are correct at the time the information is entered into the system. However, we reserve the right to change prices at any time without notice to you (except that any changes will have no effect on orders for which we have sent you a Shipping Confirmation).

You may be subject to import duties, taxes, and tariffs (including VAT), which are imposed once the delivery reaches your destination country. Such additional charges must be borne by you. (If your delivery address is within the European Union ("EU")) You should note that customs policies and practices vary significantly from one country to another. We recommend that you contact your local customs office for further information. Payment can be made by one of the major credit or debit cards or through our PayPal account. Payment will be debited from your account before the shipment of your goods or the provision of the service intended for you.

In the unlikely event that the price displayed on the payment page is not correct and we discover it before accepting your order in accordance with clause 9, we are not obliged to sell you the goods at the displayed price. We always try to ensure that the prices of goods displayed on our website are accurate, but sometimes genuine errors can occur. If we discover an error in the price of the goods you ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If you cancel your order after paying for the goods (but they have not yet been shipped), you will receive a full refund.

You confirm that the credit card, debit card, or PayPal account used belongs to you. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses or does not authorize, for any reason, the payment to our benefit, we will not be responsible to you for any late delivery or non-delivery.

If your payment card cannot be debited for any reason, we reserve the right to retry the debit within 48 hours. In the event that the payment could not be made, we will send you a 48-hour notice to the email address listed on your account to allow you to resolve it. If this poses a problem for you, you must cancel your order in advance.

You can only use one promotional code per order. We reserve the right to reject or cancel any orders for which more than one promotional code has been added to the cart.

We allow you to use discount codes strictly according to the terms and conditions under which they were issued and which, among other things, may include conditions related to your eligibility for their use and a maximum order value. Please familiarize yourself with these terms and conditions before placing an order, as we reserve the right to reject or cancel any orders that do not comply with these conditions, even if your credit or debit card has been charged. In the event of a conflict between the terms and conditions under which the discount codes were issued and these terms and conditions, the discount code terms and conditions shall prevail. Customs clearance responsibilities

You are considered the importer of the goods in your destination country and are solely responsible for complying with the applicable import formalities.

According to the legislation in force in your country, customs authorities may require the payment of customs duties, import taxes, administrative fees, or any other amount related to the clearance of your package. These potential fees are exclusively your responsibility.

The amount of these fees, when applicable, is determined solely by the customs authorities and, if applicable, by the carrier responsible for customs clearance. The Oriental Herborist does not intervene in any way in their calculation, collection, or setting and has no prior information regarding their amount.

Customs regulations, exemption thresholds, taxes, and procedures vary from country to country and may change at any time; it is the customer's responsibility to inquire with the competent customs authorities in their country before placing an order.

The refusal to pay any duties, taxes, or customs clearance fees that may be required does not constitute a reason for cancellation or refund of the order. In the event that the package is refused, abandoned, or returned due to non-payment of these fees, return, storage, destruction fees, or any other costs charged by the carrier or the competent authorities may be deducted from any potential refund or remain entirely the responsibility of the customer.

 

12. Intellectual Property

The website content is protected by copyright, trademarks, database rights, and other intellectual property rights, and you acknowledge that the documentation and content provided as an integral part of the website must remain with us or our licensors.

You may retrieve and display the website content on a computer screen, store said content electronically on a disk (but not on a server or any other network-connected storage device), or print a copy of said content for your own non-commercial use, provided that you leave all copyright and exclusivity notices intact. However, you may not reproduce, modify, copy, distribute, or use any material or content from the website for commercial purposes.

These Terms constitute the entire basis of any agreement concluded between you and us.

16. Applicable law and jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales, and all disputes will be exclusively resolved by the English courts.

17. Returns

Returns are entirely the responsibility of the customer.

In case you wish to return a product, for any reason, you have a period of 48 hours from the date of receipt of the order to inform us that you are not completely satisfied with the item. If you return it, please contact our Customer Service and provide them with your order number, the item number you wish to return, and the reason for the return.

We will provide you with a return authorization number and the address to which you will need to send the product.

The item must be well wrapped and included in the package:

The reason why you want to return the product.

The returned item(s) must be new, unused, and in their original box perfectly intact with a copy of the invoice or shipping notice.

Once we have received the items, we check them and, if we consider it necessary, we will refund the amount paid for the items minus the shipping charges. We cannot offer shipping fees for unwanted items due to the perishable nature of the items we sell. We will only offer refunds/exchanges for those items that are defective upon shipment.
